Aimee Joy Photography creates a client record for each new contact form. Aimee Joy Photography and Design’s client records are externally hosted by Gmail. Their privacy policy can be found here: Your personal data (email address) will be stored within https://policies.google.com/privacy system, on their servers and will be used to email you only with information relevant to your enquiry. Only Aimee Gale will have access to your personal data (email address) stored on the system on behalf of Aimee Joy Photography. It will only be used as detailed above, it will not be used for any marketing purposes and will not be passed onto any third parties. Gmail records are private and can be used exclusively by the account owner. Gmail never discloses the content of form submissions under any circumstance, unless specifically requested by legal state authorities.
By completing this contact form you agree to Amy Gale contacting you about Aimee Joy Photography and Design’s photography services. You will not be added to any mailing lists and will only be contacted by Amy Gale personally in relation to your enquiry. Your personal details will not be used for any marketing purposes nor will they be passed onto any third parties. They will only be stored in the email generated by this contact form which will be filed in the email account for Aimee Joy Photography which is hosted by Gmail and which can only be accessed by Amy Gale. A non-refundable booking fee of 30% as well as full acceptance of their contract, secures the time and services of the Photographer(s) for the wedding/photoshoot. The booking fee is non-refundable in the event of cancellation; it being the agreed loss suffered by the photographer due to a cancellation when made 12 months and above from the wedding/photoshoot date. See cancellation section for further details. The booking fee will be deducted from the cost of the client's chosen package when calculating the final balance due.
The Client will be presented with a carefully chosen selection of images by Aimee Joy Photography, these images will be in the form of JPEG’s. The Client will not have access to any unedited images or RAW image files. It is strongly recommended that the clients save multiple copies of their images to avoid accidental loss or corruption of the images. The Clients online gallery will be available for 5 years from the date of publication. Aimee Joy Photography shall not be held responsible for the loss of images once they have been delivered.
For a booking involving a church ceremony or at certain venues, the photographer's movements are sometimes restricted by the official in charge. The Client understands that the photographer must follow all rules given to them by the person/s facilitating the wedding and are not held liable for failure to deliver should the photographer be told that they are not allowed to take photos during the ceremony or be stationed in one spot. It is the client’s responsibility to understand the rules ahead of time.
Delivery of images shall be given via a private online password protected gallery where the Client may view, downloads and share their images. They may create selections of favourite images along with purchasing addition professional printed products and albums via an online shop integrated into their gallery. Images shall be delivered within 6-8 weeks from the wedding date, and within 4 weeks from the photoshoot date. Aimee Joy Photography will always endeavour to deliver your photographs as soon as possible.
The details of the wedding arrangements are to be agreed beforehand in writing. The Client must finalise with the photographer a schedule of hours, location(s) and desired photographs via the Event Guide Questionnaire.
The Client will be responsible for completing and submitting the Event Guide Questionnaire to Amy Gale at least two weeks prior to the wedding date. The Client shall notify the Photographer of any changes to these details in writing. The role of the Event Guide is to identify specific times/people/objects of whom/specific photographs that are desired, as well as to make certain that these subjects are available when needed. It is recommended that the clients develop a list of any desired locations and subjects (family and friends; items etc.) and share this with the photographer well before the wedding. The photographer will NOT be held accountable for not capturing specifically desired photographs if there is no one to assist in identifying or gathering people/items/locations for the photograph(s). The parties agree to positive co-operation and communication for the best possible result within the definition of this assignment. Aimee Joy Photography is not responsible for key individuals failure to be present or to co-operate during photography sessions, neither for missed images due to details not revealed to Aimee Joy Photography.
As part of this agreement, the Client is also expected to provide the Photographer(s) with a meal on the Wedding Day. It is advised for this break to commence around the same time as the Wedding breakfast.
The Photographer(s) shall be granted artistic licence in relation to the poses photographed and the locations used. The Photographers judgement regarding the locations/poses and number of images taken shall be deemed correct. The style and the number of photographs are also dependent on vagaries of the weather and the availability and willingness of the clients and their guests. The Photographer(s) will make their best effort to honour requested photographs but does not undertake any guarantee for any specific picture nor incorporate any specific background, location or group arrangement. Due to the fact it is a "live" event it may not be possible to capture all the images requested.
All images will be adjusted for exposure, brightness, contrast, sharpness, etc. The Photographer's judgement regarding these corrections and the number of images put forward to the Client for preview shall be deemed correct. Retouching, digital manipulation and artistic finishing is also included.
Owing to photo chromatic anomalies caused by a combination of certain dyes and materials, especially in man-made fibres, it is sometimes impossible to record on camera the exact colour of materials as perceived by the human eye. When processing images, Aimee Joy Photography will endeavour to achieve a pleasing overall colour balance based on natural flesh tones. It is understood that some colours may not remain consistent throughout a set of photographs owing to variations in lighting conditions. It is also understood that all photographic printing is undertaken within the technical limitations of the process and that colour may not be identical over the whole range within a subject. The colour balance of prints made at different times or in varying sizes may also be variable. Due to the limitations of computer monitors it is understood that images may appear differently according to the specification of each monitor and that prints will not match images rendered on any particular computer monitor.
Clients acknowledge that all work created under this agreement is the intellectual property of the photographer who shall retain ownership and all rights to the copyright of the photographic materials. The copyright Designs and Patents Acts assign the copyright of the images to the photographer. Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of The Photographer in writing.
The photographer grants the Client a license of use. The Client has permission to make copies of the images under the following conditions: The images taken by the photographer are for personal use only by the client and their family and friends, at no additional cost. The Client does not have permission to use the photographs for commercial use. The photographs are not to be sold. The Client will not have access to any unedited or RAW image files.
The Client is not permitted to share photographs directly with other wedding suppliers. If the Client is approached by a wedding supplier or wedding venue in regards to attaining usage of the photographs, the Client must direct them to the photographer. An agreement for the usage of photographs shall then be made between the photographer, the Client and the third party in question.
The Client may publish photographs to social media if they wish. Images may not be edited or have filters applied to them. The Client agrees to not digitally manipulate the work for public viewing (social networking, website or public photo galleries) and agrees to include a photo credit of “Photo By: Aimee Joy Photography” with each selection of photographs shared.
Aimee Joy Photography may use any images included in this contract on their website, portfolio, literature, display areas, exhibitions, competitions, advertising, slide shows or commercially unless the subjects express the wish for this not happen prior to the event.
Aimee Joy Photography reserves the right, with your consent, to select photographs to be used for these promotional purposes. Showcasing work is a key aspect of Aimee Joy Photography’s business as it paramount to promoting its services. The photographer will choose the best selection of photographs to be showcased via the photographers website, social media platforms and on occasion, promotional products. Photographs on occasion may be submitted to lifestyle photography blogs, wedding suppliers and photography related websites; providing that the images are used lawfully and without damage to Aimee Joy Photography ’s clients.
The rights of the people captured in these photographs are protected by Aimee Joy Photography, further details of this are found in the Privacy Policy at www.aimeejoy.com. The Photographer has unrestricted use of these images and can use them wholly or in part in any publication (commercial or otherwise), portfolio or public display with any retouching or alteration without restriction. At events, it is the client’s responsibility to notify guests of this unrestricted use; that attending the event acts as a model release.
Amy Gale respects the privacy of every client. Under the new GDPR law, every client photographed by Aimee Joy Photography must now consent for photographs to be displayed. The process for this is to tick the consent box at the end of this document.
By ticking the box of consent the Client hereby assigns the photographer the irrevocable and unrestricted right to use and publish photographs of the client(s). The client releases all claim to profits that may arise from use of images.
The Client may not resell, relicense, redistribute the photographs. Use as a derivative work, and reselling or redistributing such derivative work is prohibited. Images may not be used in a pornographic, obscene, illegal, immoral, libellous or defamatory manner. Images may not be incorporated into trademarks, logos, or service marks.
The photographer grants the client a print release on all photographs for personal use only. There is no limit on how many times the photographs may be printed.
While Aimee Joy Photography takes the utmost care with respect to exposure, processing and delivery of photographs, in the event that the images become lost, stolen or destroyed, for reasons beyond the control of the photographer(s), liability is limited to a refund of retainer and payment received. The limit of liability shall not exceed the contract price stated herein. The photographer(s) will not be held responsible for any ruined photographs due to any cause outside of their control.
No travel expenses are applied to weddings within an 80 mile radius from Poole, Dorset, calculated using the postcode BH16 6ED. Distances in excess of this will incur a small surcharge of 45 pence per mile. If your wedding venue is more than a 2 hour journey from Poole, Dorset an overnight stay may be required and a charge for hotel accommodation. When documenting a destination wedding, my wedding photography prices will remain the same, but there will be an additional charge to cover travel and accommodation expenses.
Any additional hours or hours worked above the time set out in the package you have chosen will be charged at £100 per hour.
In the unlikely event that the photographer(s) is unable to photograph the Wedding Day due to: illness, emergency or accident, every effort will be made to find a suitable replacement Photographer. If unable to reschedule or find a professional replacement Photographer, the payment(s) made to Aimee Joy Photography will be refunded in full. The return of the payment(s) shall be the entire obligation under this contract. No other damages or guarantees of any kind are recognised or warranted.
If the Client needs to postpone their wedding and reschedules for an off peak wedding season date (November-March) within 78 weeks (18 months) of their original wedding date, then, subject to the Photographer’s availability on the new date, the Photographer and Client will execute a new contract and all monies paid shall be transferred over to the new date.
Should the new wedding date be more than 78 weeks (18 months) from the original date, or postponed to a peak wedding season date (Friday- Sunday, April - October) then the postponment booking will involve a cancellation and a retainment of the 30% booking fee, followed by a new contract agreement made for the new wedding date. The new booking will be subject to the Photographer’s increased annual prices and will therefore need to pay the current collection price in full.
If the Photographer is unavailable on the new date, the contract will either be cancelled and the Client will be liable to pay a cancellation fee as stated in the cancellation section of this contract. Or, a carefully selected professional associate photographer will be agreed upon between the Client and the Photographer to photograph the wedding day on Aimee Joy Photography’s behalf. This will result in an additional fee to partially cover the payment of employing the associate photographer for the day. The remainder of the wedding photography collection shall be completed and delivered by Aimee Joy Photography.
The Client may cancel this contract at any time by giving written notice to Aimee Joy Photography, but in doing so may forfeit any monies paid. The written notice may be received in the form of a formal email to info@aimeejoy.com. The date of cancellation shall be the date that the written notice was sent.
If the Client cancels 16 weeks (4 months) or less before the wedding date, then the Client will be liable to pay the full invoice total of the wedding photography collection, excluding the material costs of albums or photographic products that have not yet been ordered.
If the Client cancels within 17-35 weeks (5-8 months) prior to the wedding date, Aimee Joy Photography reserves the right to charge a cancellation fee of 75% of the full invoice balance, excluding the material costs of albums or photographic products that have not yet been ordered.
For example;
Joy Collection Price = £1250
75% of £1200 = £937.50
£937.50 - £375 (30% booking fee) = £562.50 to pay
If the Client cancels between 36-52 weeks (9-12 months) prior to the wedding date, Aimee Joy Photography reserves the right to charge a cancellation fee of 50% of the full wedding photography collection, excluding the material costs of albums or photographic products that have not yet been ordered.
If the Client(s) cancel 53 weeks (12 months) and above prior to the wedding date, Aimee Joy Photography reserves the right to retain the payment of the non-refundable 30% booking fee. No other additional cancellation fee will be due.
Due to the nature of digital photography and the fact that all photographs may be viewed by the client on our website prior to purchase, once orders have been sent, Aimee Joy Photography has a strict NO REFUND/RETURN/EXCHANGE POLICY. Once a transaction has been completed, it is then considered non-refundable. If a buyer has selected and purchased an incorrect photo, he/she must notify Aimee Joy Photography, before receiving the “incorrect” photograph. Refunds will NOT be given due to “not liking a photo”, selecting an incorrect photograph after the buyer has already received the photograph, or any other reason. If a mistake photo is sent to the buyer, as documented on the invoice, Aimee Joy Photography will send the correct photo to the buyer free of charge.
